Richard A Hartley QC looks at the right and wrong ways to deal with the above heads of claim in the context of personal injury claims. This talk is aimed at the established practitioner as well as those newly qualified. The talk will focus on the proper quantification of Future Loss of Earnings and Disadvantage on the Labour Market Awards. It will include the different legal and practical approaches in Smith v Manchester, Blamire, the new Ogden Tables and the Loss of Chance cases - in the light of the recent changes. Recent experience has shown many claims vastly undervaluing Smith v Manchester and Future Loss of Earnings awards. Frequently the most significant aspect of any claim is misunderstood. It is important to get it right. This talk will look at the old and new approaches, the evidential requirements and the likely outcomes and will deal with recent authorities in this area.
