Event SummaryThe termination of the employment relationship was once only a matter of contract law. Since the introduction of the concept of "unfair" dismissals things have become more regulated and litigated.
In this talk we will look at whether nearly 40 years of unfair dismissal legislation has made it impossible to let an employee g .The main grounds of misconduct, capability and redundancy remain with "some other substantial reason" picking up the quirky ones. But other legislation has intervened to alter the qualifying period, make some dismissals automatically unfair and generally give employers many things to think about before dismissing.
Despite an official report critical of the workings of the Statutory Disciplinary and Grievance Procedures, the 2004 Regulations remain with us adding procedural hurdles to the substantive law of unfair dismissal.
